- Content that is obscene, pornographic, or sexually explicit
- Content depicting or promoting child sexual abuse or exploitation
- Content that promotes violence, terrorism, or harm to others
- Content that harasses, bullies, threatens, or intimidates any person
- Hate speech or content that discriminates based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Content that promotes self-harm or suicide
- Misinformation or disinformation intended to deceive or manipulate
- Content that violates the privacy or publicity rights of others
3.3 Intellectual Property Violations
You may not use the Services to:
- Infringe upon any copyright, trademark, patent, trade secret, or other intellectual property rights
- Distribute pirated software, music, videos, or other copyrighted materials
- Circumvent or disable any digital rights management (DRM) or copy protection mechanisms
- Remove, alter, or obscure any proprietary notices or labels
- Create derivative works from our Services without authorization

3.4 Security Violations
You may not:
- Attempt to gain unauthorized access to any systems, networks, or data
- Probe, scan, or test the vulnerability of our systems or networks

- Engage in phishing, social engineering, or credential harvesting
- Participate in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Access or use the Services through any automated means (bots, scrapers, crawlers) without our written permission
3.5 Network Abuse
You may not:
- Interfere with or disrupt the Services or servers/networks connected to the Services
- Overwhelm our systems with excessive requests, data, or traffic
- Send unsolicited bulk emails (spam) or engage in email bombing
- Operate open proxies, open relays, or Tor exit nodes through our Services
- Engage in activities that consume excessive bandwidth or system resources
- Share your account credentials or allow unauthorized access to your account
- Resell, sublicense, or share access to the Services without authorization
3.6 Fraud and Deception
You may not use the Services to:
- Engage in fraudulent schemes, pyramid schemes, or Ponzi schemes

3.7 AI-Specific Prohibitions
When using our AI and automation services, you may not:
- Use AI to generate content that violates any other provision of this AUP
- Use AI to impersonate real individuals without their consent
- Create deepfakes or synthetic media intended to deceive or harm
- Use AI to automate the creation of spam, fake reviews, or misleading content
- Use AI to engage in unauthorized surveillance or monitoring
- Use AI to make decisions that discriminate against protected classes
- Use AI to circumvent security measures or develop malware
- Use AI to generate content that infringes intellectual property rights
- Train competing AI models using outputs from our Services
- Use AI to generate medical, legal, or financial advice without appropriate disclaimers and human oversight
- Use AI in safety-critical applications without proper safeguards
- Misrepresent AI-generated content as human-created when disclosure is required
3.8 Healthcare-Specific Prohibitions
When using our healthcare solutions, you may not:
- Access, use, or disclose Protected Health Information (PHI) in violation of HIPAA
- Use the Services to make clinical decisions without appropriate professional oversight
- Submit false claims or engage in healthcare fraud
- Violate patient privacy or confidentiality
- Use the Services for purposes not authorized under your Business Associate Agreement
- Circumvent audit controls or logging mechanisms
4. User Responsibilities
4.1 Account Security
You are responsible for:
- Maintaining the security and confidentiality of your account credentials
- All activities that occur under your account, whether or not authorized by you
- Immediately notifying us of any unauthorized use of your account
- Using strong passwords and enabling multi-factor authentication when available
4.2 Content Responsibility
You are solely responsible for:
- All content you create, upload, transmit, or distribute using the Services
- Ensuring your content complies with all applicable laws and this AUP
- Obtaining all necessary rights, licenses, and permissions for your content
- Backing up your content and data
4.3 Third-Party Interactions
You acknowledge that:
- Any interactions with third parties through our Services are solely between you and the third party
- We are not responsible for the actions, content, or conduct of any third party
- You assume all risk associated with third-party interactions
5. Monitoring and Enforcement
5.1 Our Right to Monitor
We reserve the right, but are not obligated, to monitor use of the Services for compliance with this AUP. We may investigate suspected violations and take appropriate action, including but not limited to:
- Reviewing content and activities on the Services
- Accessing your account to investigate suspected violations
- Cooperating with law enforcement authorities
- Using automated tools to detect violations
5.2 Enforcement Actions
If we determine that you have violated this AUP, we may take one or more of the following actions at our sole discretion:
- Issue a warning
- Remove or disable access to offending content
- Temporarily suspend your access to the Services
- Permanently terminate your account
- Report your activities to law enforcement authorities
- Pursue legal action against you
- Seek monetary damages
We may take these actions without prior notice if we believe, in our sole discretion, that the violation poses an immediate risk of harm or liability.
5.3 No Obligation to Act
Our failure to enforce any provision of this AUP does not constitute a waiver of our rights. We are not obligated to take action against any particular violation and may choose to take action selectively.
6. Reporting Violations
If you become aware of any violation of this AUP, please report it to us immediately at abuse@nextanswerai.com. Please include:
- A description of the violation
- The date and time of the violation (if known)
- Any evidence or documentation supporting your report
- Your contact information (optional, but helpful for follow-up)
We will review all reports promptly and take appropriate action. However, we cannot guarantee any specific outcome or response time.
7. Cooperation with Investigations
You agree to cooperate with us in investigating any suspected violations of this AUP. This includes providing information and assistance as reasonably requested. You also agree to cooperate with law enforcement authorities in investigations related to illegal activities conducted through our Services.
8. Indemnification
You agree to indemnify, defend, and hold harmless NextAnswerAI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of this AUP.
9. Disclaimer
WE PROVIDE THE SERVICES "AS IS" AND DO NOT GUARANTEE THAT THE SERVICES WILL BE FREE FROM VIOLATIONS OF THIS AUP BY OTHER USERS. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR CONTENT OF OTHER USERS. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
10. Changes to This Policy
We reserve the right to modify this AUP at any time. We will notify you of material changes by posting the updated AUP on our website with a new "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the modified AUP.
